为贯彻落实国资委法治央企的要求,打造“法治铁建”,抓好项目全面法律风险防范机制建设,源头防范法律风险,提高项目主管人员的法律意识,将法律风险消灭在一线基层萌芽状态。,为期5天的中国铁建中层管理人员(项目经理)法律合规培训班在北京中国铁建培训中心举办。
培训班邀请了建筑业内知名律师、院校教授、内部法务专家进行了精彩授课。授课内容涉及最高院《关于审理建设工程施工合同纠纷案件适用法律问题的解释(二)》理解与适用、住建部《建筑工程施工发包与承包违法行为认定查处管理办法》理解与风险应对、工程项目管理法律风险防控、工程项目保险及运用、诉讼案件处理应用技巧、资本运作项目法律风险防控、工程项目管理人员应当具备的其他法律合规知识。
在开班仪式上,中国铁建副总法律顾问、法律合规部部长王甲国作了重要讲话。强调了三个方面:一是,企业依法合规工作愈发重要。对标国际一流企业合规管理工作经验,结合美国长臂管辖案例,国内依法治国背景下企业管理日趋规范,由外部监管环境要求,到企业内部管理需求强调了法律合规工作的重要性。二是,加强基层项目法律工作机制体制建设。项目部应从规章制度制定、四项法律审核、法律联络员培养建设、项目合规程序管理等方面入手注重项目的法治工作建设,防范项目法律风险。三是,珍惜此次培训机会。通过此次学习,切实提高项目管理人员的法律意识,培养综合法律素养,加强法律风险辨识和防控能力,全面提升项目法律风险管理水平。股份公司法律合规部副部长刘兵做了结业讲话,要求各位项目管理人员牢固树立法律意识,加强法律业务知识学习,探索项目管理法律管理经验,为打造法治铁建贡献自己的力量。
